These terms apply to the following companies: TomasSystems (tomas.systems, tomassystems.net); ProtCharge (protcharge.net); Tomas Smith Group (UK) (tomassmith.group).

Accounts

When you create an account with us on any of our companies, you must provide accurate information, complete and current at all times. Failure to do so may result to a breach of terms which could result in a termination of your service(s).
You are responsible for the safeguarding the password that you use to access the service(s) and for any activities or actions under your password, whether your password is with our service or a third-party service.
You agree not to disclose your password to any third-party, you must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Refunds

Most services are prepaid when using a company operated by Tomas Smith Group (UK). Refunds may be offered within 24 hours after the activation of your service(s) with a good reason. The decision is made on a case-by-case basis. Violating our Terms Of Service deems you inelibigle for a refund.


Chargebacks

Debit/Credit Card or PayPal chargebacks/disputes are prohibited and will result in a termination of service, or suspention of your services without any prior warning. Chargebacks/Disputes disqualify you, the user from receving a refund for any payments and will prohibit future ordering.


Termination / Service Abuse & Acceptable Use Policy

By using our service(s), you agree not to abuse systems or networks in any way that may harm the usabiltiy of other client services, or harm outside networks or individuals.
We may terminate or suspend access to your service(s) immediately, without prior notice or liability, for any reason, including without limitation if you breach the terms.
Prohibited actions include:

  • Attacking/Harming outside networks. (DoS/DDoS attacks)
  • Harming users. (Hosting or providing malicious files or malware)
  • Abnormal/High network usage (Over 90 Mbit/s upload/download or a high PPS (packets per second)) over a long period of time (multiple hours).
  • Abnormal/High CPU usage (over 90%) over a long period of time (multiple hours).
  • Hosting/Providing illegal content. (Copyright or Tradepark infringement)
  • Piracy. (Use of cracked licenses)
  • TOR Exit Nodes.
  • Hosting/Providing fraud of phising content.
  • Hosting/Providing gambling/lottery sites.
  • Email spamming.
  • Network scanning in any way shape or form.
  • Harming other users on the network.
If your IP address which is assigned to your service(s) gets blocked/banned by our provider(s), your service will be suspended and you will have 3 days to respond with a valid reason as to why it was suspended and what steps you will take to prevent this in the future.
We have the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the terms.
Upon expiration of a service(s), your right to that service(s) will cease immediately. If you wish to terminate your service(s), please contact us.
We are not responsible for reminding you to extend your service(s) / pay invoices, however we do so in most circumstances as a gesture of good will.


Data

You are responsible for any data on your service(s). Tomas Smith Group (UK) are not responsible for any loss of data that may occur during rare incidents such as a hardware failure, however we will always attempt to restore your service from a automated backup we take. You are responsible for ensuring your data is backed up.

Governing Law

These terms shall be governed and constructed in accordance with the laws of Wales, United Kingdom without regard to its conflict of law provisions.
Our failure to enforece any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect.
